This document outlines the terms under which MyTasker provides its services.
Agreement Overview
These Terms & Conditions form a binding agreement between you (the "Client") and MyTasker (the "Contractor"). MyTasker is operated by Tasker Virtual Assistance Services Private Limited. By purchasing or using our services, you agree to these terms.
These Terms are effective from the date of your first purchase of MyTasker services.
We may update these terms from time to time. When we do, we will notify you in advance. The latest version will always be available on our website. Continued use of our services means you accept the updated terms.
Services
We provide virtual assistance and related administrative services based on the plan you purchase. All services are delivered with reasonable care and professional skill, consistent with industry standards.
MyTasker may assign your work to one or more trained virtual assistants (VAs) at its discretion.
Subscription, Payments, and Refunds
Payments & Renewal
- Services are prepaid based on your selected plan.
- Plans automatically renew each month unless you cancel before the billing date.
- Payments are charged in advance to your card and PayPal account.
- Unused hours do not carry over to the next month.
- Services may be paused if payment fails.
Additional Expenses
Any third‑party or out‑of‑pocket expenses required to complete your tasks must be paid separately by you.
Confidentiality
Both parties may access confidential information during the course of services. Each party agrees to:
- Keep all confidential information private and secure.
- Use it only for service‑related purposes.
- Protect it with reasonable safeguards.
- Return or destroy confidential materials upon .
Confidential information does not include data that is publicly available or lawfully obtained from another source.
Confidential information may be disclosed if required by law, regulation, or valid court or governmental order, provided reasonable notice is given to the other party where legally permitted. Confidentiality obligations continue even after services end.
Mutual Assurances
Both parties confirm that entering into this agreement does not violate any other contracts or obligations.
Refund Policy
1. Refund Eligibility?
You may request a refund within 10 days of the charge (applicable for both first-time and ongoing subscriptions). We will issue a full refund of the last payment, excluding 5–6% transaction reversal charges, only if the service has not been used at all during this period.
2. Dissatisfaction or Service-Related Concerns?
If you are dissatisfied with the service, you may submit a refund request outlining your concerns. Each request is reviewed by our quality assurance team. If the issue is found to be on our side, we may approve a full or partial refund.
3. No-Refund Conditions?
Once any portion of the service is used after the most recent payment, the purchase becomes non-refundable. Any remaining hours must be utilized within the applicable validity period and cannot be refunded or carried forward.
4. How to Request a Refund?
Refund requests must be submitted from your registered email address (used at the time of signup) to [email protected]. You may also contact us via phone, live chat, or submit feedback through the “Feedback Box” available in the MyTasker dashboard or app.
Please include your payment details, subscription information, and a brief explanation to enable us to review the request seamlessly.
5. Processing Timeline?
Approved refunds are processed within 7–10 business days.
Client Responsibilities
1. Direction & Supervision
Your VA works under your instructions. Any decisions made on your behalf are considered to be under your supervision and responsibility.
2. Account Access & Passwords
If you choose to share login credentials, you do so at your own risk. You are responsible for protecting your data. We strongly recommend using MyTasker’s encrypted password vault.
3. Copyright & Content Use
You are responsible for ensuring that any content, images, or materials used have the required permissions. MyTasker is not liable for copyright violations arising from your instructions.
4. Acceptable Use?
You may not use MyTasker services for illegal, unethical, or immoral activities.
5. Indemnification
You agree to protect and hold harmless MyTasker and its team from claims or losses resulting from your instructions or misuse of services.
You acknowledge that MyTasker and its VAs do not provide legal, financial, tax, or other professional advice and act solely based on your instructions. You waive any claim that MyTasker or its VAs are acting in an advisory, consultative, or fiduciary capacity.
6. Account Cancellation
You may cancel your account anytime before the next billing date via the MyTasker portal or by contacting support.
Independent Contractor Relationship
MyTasker operates as an independent contractor. This agreement does not create an employer‑employee, partnership, or agency relationship.
You are not responsible for any taxes, statutory obligations, employee benefits, social security contributions, or insurance relating to MyTasker or its personnel.
Governing Law & Dispute Resolution
This agreement is governed by the laws of West Bengal, India. Any disputes will be resolved exclusively under this jurisdiction, including binding arbitration where applicable.
By agreeing, you waive the right to a jury trial or litigation in other jurisdictions.
Limitation of Liability
To the extent permitted by law:
- MyTasker’s liability is limited to the amount paid by you in the previous 12 months.
- Neither party is liable for indirect, incidental, or consequential damages, including lost profits or business interruption.
Any claim or cause of action arising out of or relating to these Terms or the services must be brought within one (1) year from the date the claim arose, failing which such claim shall be permanently barred.
Non‑Solicitation
You may not directly hire, recruit, or encourage MyTasker staff or VAs to work with you outside of MyTasker.
If this occurs, you agree to pay liquidated damages of USD 25,000 per staff member, representing reasonable replacement and training costs. This amount is not a penalty.
Entire Agreement & Severability
This document is the complete agreement between you and MyTasker. If any part is found unenforceable, the rest of the agreement will continue to apply.
Notices
All official notices must be provided in writing and may be sent by courier, registered mail, or email with confirmation of receipt.
